§ 1. GENERAL PROVISIONS These Terms and Conditions set forth the rules governing reservations, payments, and stays at tourist accommodations located in Montenegro and offered on the website. The Lessor and owner of the website is: Apartico Montenegro D.O.O. with its registered office at Igalo, Montenegro, email: aparticomontenegro@icloud.com , phone: +382 682 75 75 3. Making a reservation through the Smoobu booking system on the website constitutes full acceptance of these Terms and Conditions by the Tenant (hereinafter referred to as the “Guest”). The tourist rental agreement is concluded upon the automatic generation and sending of a booking confirmation by the Smoobu system to the Guest’s email address or via another form of confirmation.
§ 2. BOOKING AND PAYMENT PROCESS Bookings are processed in real time by the Smoobu system. All prices on the website are listed and charged in euros (EUR). Payments are made via SEPA bank transfer or cash. A 30% deposit is required at the time of booking. Failure to make the payment within the time specified by the system will result in automatic cancellation of the reservation.
§ 3. REGISTRATION OBLIGATION (BIJELI KARTON) and TOURIST FEE: According to Montenegrin law, every foreigner is required to register with the local tourist organization (Turistička organizacija) or the police within 24 hours of crossing the border. Guests are strictly obligated to send scans/photos of identity documents (passport or ID card) of all persons who will be staying at the property, no later than the day of check-in. Refusal to provide personal data prevents the Guest from legally checking in and constitutes grounds for immediate cancellation of the reservation due to the Guest's fault, without any right to a refund. The standard tourist fee (Boravišna taksa) in Montenegro is €1.00 per adult per night. The concierge is equipped with a government application for registering guests via phone. The Guest will immediately receive confirmation of registration in the system. This fee is NOT included in the booking price and will be collected in cash on site.
§ 4. CANCELLATION OF RESERVATIONS AND WITHDRAWAL The terms of cancellation depend on the rate selected during the reservation process in the Smoobu system (flexible or non-refundable). In accordance with regulations governing tourist accommodation services, a Guest who is a consumer does not have the right to withdraw from a distance contract within 14 days without giving a reason. Each cancellation is processed in accordance with the terms of the selected rate.
§ 5. HOUSE CONDITIONS AND RULES OF USE OF THE FACILITY Check-in begins at 3:00 PM and ends at 10:00 AM. Check-in takes place in person or via the key box. Nighttime quiet hours and siesta: Guests are obligated to comply with local rules of social coexistence (Kućni ed.). Nighttime quiet hours are from 11:00 PM to 7:00 AM, and afternoon rest time is from 2:00 PM to 5:00 PM. Gross violation of nighttime quiet hours, organizing parties or intervention of the Municipal Police (Komunalna policija) entitles the Lessor to immediately remove Guests from the property without refund and retaining the entire deposit. Air conditioning: Due to the high load on the power grid in Montenegro and environmental protection, it is prohibited to leave the air conditioning on with windows/balcony doors open or when Guests are not in the property. Smoking and e-cigarettes are strictly prohibited in the property under penalty of a contractual penalty of EUR 200 and coverage for any damages.
§ 6. COMPLAINTS AND LIABILITY The Guest should report any faults or discrepancies between the property and the description immediately upon detection by e-mail to:aparticomontenegro@icloud.com
The Landlord will consider the complaint within 14 days of its receipt. The Landlord is not responsible for interruptions in the supply of utilities (electricity, water, internet) beyond its control, which may occasionally occur in Montenegro during the summer season.
§ 7. PERSONAL DATA PROTECTION (GDPR) The personal data of Guests are processed by the Landlord in order to execute the rental agreement and to comply with the registration obligation in Montenegro. The Smoobu system processes data in accordance with its Privacy Policy in order to properly process reservations.
§ 8. JURISDICTION AND GOVERNING LAW In matters not regulated by these regulations, the laws of Montenegro shall apply. Any disputes arising from the performance of lease agreements for real estate located in Montenegro shall be resolved by the court with jurisdiction over the location of the real estate in Montenegro/the Landlord's registered office. The parties shall endeavor to resolve any disputes amicably.
